§ 1 Scope and Contracting Parties

These General Terms and Conditions apply to all contracts between Saskia Wegele, Permanent Makeup, Ahornstraße 21, 85774 Unterföhring – hereinafter referred to as the “Provider” – and her customers concerning Permanent Makeup treatments, PMU Removal, other services offered, and the purchase and redemption of gift vouchers.

Customers may be consumers or entrepreneurs. A consumer is any natural person who enters into a legal transaction predominantly for purposes that can be attributed neither to their commercial nor to their independent professional activity.

Any deviating, conflicting or supplementary General Terms and Conditions of the Customer shall only become part of the contract if their applicability has been expressly agreed.

§ 2 Offers and Conclusion of Contract

The presentation of services, prices and other information on the website does not, as a rule, constitute a binding contractual offer unless expressly stated otherwise.

A treatment appointment becomes binding once it has been confirmed by the Provider and any agreed deposit has been received.

For gift vouchers ordered online, the information required to create the voucher is first submitted via the website form. The Customer is then redirected to PayPal for payment processing.

Submitting the form alone does not constitute a completed purchase of a gift voucher. The contract for the gift voucher is concluded following successful payment and acceptance of the order by the Provider, and at the latest when the voucher is sent by email.

§ 3 Consultation, Medical History and Treatment Requirements

Before any Permanent Makeup or PMU Removal treatment, an individual consultation and assessment of the respective starting point will take place.

The Customer is obliged to provide complete and truthful information about all health-related circumstances relevant to the treatment. This includes, in particular, existing medical conditions, allergies, skin changes, medication, current medical or cosmetic treatments, and any other circumstances that may affect the treatment.

The Provider is entitled to refuse, postpone or discontinue a treatment if, from a professional perspective, there are concerns regarding the suitability or safety of the treatment.

Contraindications and treatment-specific information will be explained as part of the consultation and medical history assessment and, where applicable, in a separate consent or information document.

Treatments for minors will only be carried out following prior express agreement and subject to the applicable legal requirements. There is no entitlement to treatment for minors.

§ 4 Scope of Treatment and Treatment Result

Permanent Makeup and PMU Removal may involve several treatment appointments, depending on the service and the individual starting point.

The services, appointments or perfection treatments included in the respective price are determined by the service description, price overview or individual agreement applicable at the time the contract is concluded.

Additional treatments that are not part of the agreed service will only be carried out following prior consultation and will be charged in accordance with the applicable price list.

The result of a Permanent Makeup or Removal treatment is influenced by numerous individual factors. These include, in particular, skin condition, metabolism, the healing process, pigment retention, aftercare and other individual circumstances.

A specific aesthetic treatment result or a particular degree of longevity therefore cannot be guaranteed.

The Customer’s statutory rights remain unaffected.

The Customer undertakes to follow the individually provided aftercare and care instructions as carefully as possible.

§ 5 Appointment Booking and Deposit

Agreed treatment appointments are binding for both parties.

The Provider may require a deposit of up to 50% of the agreed treatment price when an appointment is booked.

Any deposit paid will be credited towards the treatment price.

Where an appointment is booked using a gift voucher, the voucher number may be recorded as security for the appointment. Any amount due will be offset against the value of the service actually provided or, where justified, against any cancellation compensation payable.

§ 6 Late Arrival, Cancellation and Non-Attendance

The Customer is obliged to arrive on time for the agreed appointment.

In the event of a significant delay, the treatment time may be shortened accordingly if subsequent appointments would otherwise be affected. If it is no longer possible to carry out the treatment professionally within the remaining time, the appointment may be cancelled.

Appointments may be cancelled or rescheduled free of charge no later than 48 hours before the agreed appointment time.

For cancellations made between 48 and 24 hours before the appointment, a cancellation fee of up to 50% of the agreed treatment price may be charged if the appointment cannot be reallocated.

For cancellations made less than 24 hours before the appointment, or in the event of non-attendance, the Provider may claim compensation for the actual loss incurred, up to the amount of the agreed treatment price. Any expenses saved and any income received from reallocating the appointment will be taken into account.

The Customer expressly retains the right to demonstrate that no loss, or a substantially lower loss, was incurred.

Any cancellation compensation due may be offset against a deposit already paid or a gift voucher recorded for the appointment.

If an appointment cannot take place for reasons beyond the Provider’s control, in particular due to illness or force majeure, the Customer will be informed as soon as possible. Any deposits already paid will be transferred to a replacement appointment or, at the Customer’s request, refunded if no replacement appointment is agreed.

§ 7 Prices and Payment Terms

The prices agreed at the time the contract is concluded, or the price and service overview current at that time, shall apply.

Unless otherwise agreed, treatment prices are due immediately after the treatment.

Agreed deposits must be paid at the time specified when the appointment is booked.

The payment methods available at any given time are set out on the website, in the appointment arrangements or among the payment methods offered at the studio.

Gift vouchers ordered online are paid for through the PayPal payment process provided for this purpose.

§ 8 Gift Vouchers

Gift vouchers are issued as value vouchers and may be used for eligible services offered by Saskia Wegele – Permanent Makeup.

When redeemed, the value stated on the voucher will be credited towards the price of the selected service applicable at the time of treatment.

If the treatment price exceeds the available voucher value, the Customer must pay the difference.

If the full voucher value is not used when redeemed, the remaining balance will remain available and may be used for another service within the validity period.

Cash payment of the voucher value or any remaining balance is excluded.

Claims arising from a gift voucher become statute-barred after the statutory standard limitation period of three years. The period begins at the end of the year in which the claim arose. The standard limitation period is three years.

Different conditions and promotional periods may apply to promotional vouchers, discount vouchers or vouchers issued by cooperation partners. These are determined by the terms of the respective promotion.

§ 9 Online Orders of Gift Vouchers

When ordering a gift voucher online, the Customer first enters the information required to create the voucher using the website form.

After submitting the form, the Customer is redirected to PayPal for payment processing. The desired voucher value can be entered there and payment completed.

Submission of the form alone does not constitute confirmation of payment.

The voucher will only be created once payment has been confirmed.

The Provider personally creates the voucher using the information submitted and then sends it to the email address provided.

The Customer is responsible for providing a correct and accessible email address.

If the voucher has not been received within 24 hours of successful payment, the Customer is advised first to check the spam folder and then to contact the Provider.

§ 10 Right of Withdrawal for Distance Contracts

Consumers generally have a statutory right of withdrawal in the case of distance contracts, unless a statutory exception applies. The withdrawal period is generally 14 days.

For gift vouchers purchased online, the separately provided withdrawal information and model withdrawal form apply.

The information contained there regarding the requirements, period, procedure and consequences of withdrawal forms part of the pre-contractual consumer information.

Statutory provisions governing the expiry or consequences of the right of withdrawal remain unaffected.

§ 11 No Guarantee of Results

The Provider carries out all treatments to the best of her knowledge and in accordance with the agreed scope of services.

Due to individual physical and skin-related factors, no specific aesthetic result, particular colour development or specific degree of longevity can be guaranteed.

This does not, however, exclude statutory rights in the event of a service that is in fact defective or performed in breach of contractual obligations.

§ 12 Liability

The Provider shall have unlimited liability for damage caused intentionally or through gross negligence.

The Provider shall also have unlimited liability for damage arising from injury to life, body or health, as well as in cases of mandatory statutory liability.

In the event of a slightly negligent breach of a material contractual obligation, liability shall be limited to the foreseeable damage typical of the contract.

In all other respects, liability for damage caused by slight negligence is excluded to the extent permitted by law.

The above liability provisions apply accordingly to the Provider’s legal representatives and persons employed in performing her obligations.

Mandatory statutory liability provisions, in particular those arising under the German Product Liability Act, remain unaffected.

§ 13 Changes to Prices and Terms

Changes to prices apply only to future contracts.

For contracts already concluded, the price agreed at the time the contract was concluded shall apply.

Changes to these General Terms and Conditions likewise generally apply only to future contracts, unless expressly agreed otherwise with the Customer.

§ 14 Data Protection

Personal data is processed exclusively in accordance with the applicable data protection legislation.

Further information on the processing of personal data can be found in the Privacy Policy published on the website.

§ 15 Set-Off and Rights of Retention

The Customer is entitled to set off claims where the counterclaim is undisputed or has been finally determined by a court.

Statutory rights of set-off and retention remain unaffected, in particular where they arise from the same contractual relationship.

§ 16 Final Provisions

German law shall apply.

For consumers whose habitual residence is in another Member State of the European Union, mandatory consumer-protection provisions of the respective state of residence remain unaffected.

For consumers, the statutory place of jurisdiction shall apply.

If the Customer is a merchant, a legal entity under public law or a special fund under public law, the Provider’s place of business may – to the extent permitted by law – be agreed as the place of jurisdiction.

Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
